Legal Warranty


According to the Legislative Decree 206/2005 (Consumer Code) all items for sale in our website are covered by Legal Warranty of 24 months to the final consumer for conformity defects according to the decree-law 24/2002 and 12 months to professional consumers and companies that buy with TVA. To receive warranty service, the Customer has to keep the receipt or invoice (if requested by the customer at the time of purchase), that will be received via email and in some cases and for some specific brands it has to keep the packaging too.


To proceed with the repair of the product, the customer can contact the manufacturer, or in the event of difficulties, the customer can contact us and we will give all information to take advantage of the warranty. The manufacturer's warranty is given according to the modalities illustrated in the documentation inside the packaging of each product. If, after the intervention of an authorized service center, the defect should not be covered by the manufacturer's warranty, the customer has to pay all costs of verification and repair requested by authorized service.

 
Dagimarket DVG Commerce Srl cannot be held responsible under any circumstances for the activities of technical assistance centers on products: delays in repairs and/or replacements, and/or non-recognition by the authorized technical service center about operating defects as provided by Decree-law n. 24/2002, and/or any other case deemed detrimental to the customer, are exclusively attributable to the policies of the Manufacturer.

In cases where the application of the warranties predicts the return of the product, the item shall be returned by the customer at own expense in the original package, with all its parts (including packaging and any documentation and ancillary equipment, intact consumable, manuals, cables, etc.); to limit damages to the original package, we recommend, whenever possible, to place it in a second box; It should be avoided in all cases the affixing labels or adhesive tapes directly on the original packaging.
It will be rejected back to the sender, with charges against him, all shipments of products:

-Not including packaging, accessories and manuals;
-Received with outer packaging unfit or inappropriate and therefore damaged during transport: this warranty does not cover damages caused by the non-use of original packaging and adequate protective outer packaging not authorized by the Service Center.
 

The lack of conformity exists when the product is not suitable for the use to which must serve, when it does not conform to the description or does not possess the qualities promised by the seller, it doesn't offer usual quality and performance of goods of the same type, it is not suitable for the particular usage desired by the consumer if it brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the consumer code).

In case of lack of conformity that occurs within 24 months (12 months for professional user) from the date of purchase, the consumer should contact us at our email address amministrazione@dagimarket.com for product assistance, we will evaluate with the customer if the product will return or it will send it directly to the manufacturer's technical support. For all products with lack of conformity submitted after 6 Months from the date of purchase, the transport cost will be paid by the customer.




Right of withdrawal

According to the Consumer Code, modified by Legislative Decree n. 21/2014, the Customer, as a consumer and therefore the physical person who hasn't professional purpose, i.e. the customer doesn't buy the items with a VAT number, has the right to withdraw from purchase contract no later than 14 days from delivery, i.e. from the day when the Costumer acquires the physical possession of purchased items. The conditions and the procedure to exercise this right will be specified in the following paragraphs. 



 1. The Costumer who wants to exercise the right of withdrawal, provided by the previous paragraph, has to use the form found on the Account area in the dedicated section. Anyway, the Customer can always inform us via email to amministrazione@dagimarket.com, or through any kind of communication , the intention to exercise the right of withdrawal within the terms provided by the law. Our Customer Service will take charge this request and it will open it on the Customer Account. When the declaration of withdrawal is received and accepted, Dagimarket will send to the Customer an email about the confirmation of the receipt with in attached the return form (RMA) provided with the number of authorization that it will be put in the packaging of the item to return.  To complete the return request, the Customer can log in the personal area and finish the procedure to request the withdrawal of the item through the Dagimarket trusted courier. The Customer can choose an other courier that has a tracking number. In both cases, the transport cost for the return of the product to Dagimarket will be recovered from the Customer. When this procedure is finished, the Customer will has to ship the product, carefully packed in its original packaging, within which the Customer has to put the authorization of return (RMA form), through the Courier, to the following address:

2. The shipment of the item to return has to take place no later than 14 days from the date when the Customer has communicated to Dagimarket the decision to withdraw from the purchase contract. According to the article 56 of Legislative Decree n. 21/2014, after a verification of the respect of the conditions listed in the paragraph 03, Dagimarket will refund to the Customer the price of the product no later than 14 days from the reception of the withdraw communication, without prejudice to the right to withhold the refund up to the return date of the product in our warehouses or up to the date when the Customer will send a proof about the shipment and delivery of the items to the courier. Dagimarket is not required to refund the supplemental cost if the Customer chooses a different kind of delivery compared to the cheaper delivery. The refund will take place with the same modalities used by the Customer for the purchase, i.e., if it is specifically required, by bank transfer, credit card or PayPal. In case of orders with financing, the refund will be by bank transfer. In case of orders on our partner sites (Ebay, Amazon, Eprice, etc), the refund will be made by the partner.


3. The right of withdraw presents these following mandatory conditions:

A. the Customer can exercise the right of withdraw only and exclusively about the entire product: it is not possible to exercise the withdraw for a part of the purchased product (for example accessories, software, etc). If they are opened, it is not possible to return theses following products:
I. audiovisual, software and consumable items;
II. personally created for the customer;
III. perishable goods or if they change quickly;
IV. newspapers and magazines;
V. for the services, that before the expiry of the term to exercise the withdraw, have been executed with the agreement of the costumer.

B. the purchased product will has to be returned in its original packaging with all its accessories and documents;
C. the product will has to be returned in perfect condition, damaged, worn-out or dirty products will not be accepted.
D. the product has to have the same serial number of the invoice, otherwise, if the serial number is different, the withdrawal doesn't be accepted and the product will be again available for the Customer, without any refund by Dagimarket;
E. if the Customer chooses to ship the item through a courier of his choice, the return shipment of the product is under the responsibility of Customer until such time as Dagimarket will confirm the reception of the item. In the case of the product is damaged during the return to our warehouse, Dagimarket will communicate it to the Customer to allow to file a complaint towards the courier and to obtain the refund of the price, if the product is assured; therefore Dagimarket will make the product available to the Customer, by annulling the withdrawal.

4. the right of withdrawal shall cease if the Customer doesn't return the item to Dagimarket no later than 14 days from the date of communication about the withdrawal. The term is respected if the Customer ships the item before the expiry of 14 days. The right of withdrawal ceases in case of the lack of integrality of the item or in the absence of inside packaging, documents or original packaging. In this case, the product will be shipped again to the Customer who has to pay shipment cost.





DOA: Dead on ARRIVAL, the product that proves to be defective from the first use.

The DOA (Dead On Arrival) can be activated when the component is not running already from the first use. This form of guarantee may be exercised informing STRICTLY the problem within 2 days from receipt of the goods. The Customer can obtain the shipment of a new product or the total refund of the price. In any case, the eventual substitution of the product will be within 30 days from the opening of practice.



SUBSTITUTION PROCEDURE

 
The customer shall communicate through e-mail amministrazione@dagimarket.com within 2 days from receipt of the goods.

The product will be withdrawn by a courier commissioned by Dagimarket- DVG Commerce S.r.l.

The DOA product has to be placed in its original packaging with its internal protections and all accessories. Th original packaging has to be placed in an other box without inscriptions or lacerations, or alternatively it has to be recovered by a wrap to avoid any damages to the original packaging during the transport.

In absence of these conditions, it will be not possible to activate DOA service. The product will be ship again to the Customer who has to pay all shipment costs.



Extended warranty (up to 5 years)

On this website it is possible to buy a service of  Extended Warraty up to 5 year from the date of purchase, thanks to an insurance policy that renews all maintenance and after-sale services, guaranteed by manufacturers.

The purchase of GARANZIA3 is cheaper than a reparation out of warranty. In case of failure, malfunctioning or braking of the product, GARANZIA3 will give the right to reparation for additional 36 months from the expiry of legal warranty. The service actives when legal warranty expires.

To satisfy all Customer needs, GARANZIA3 has 5 kind of products according to the maximal cost sustainable for each intervention.

GARANZI3 has to be activated within 12 months from the date of purchase.

PAY ATTENTION: If the procedure isn't completed within 12 months or if the product isn't covered by the warranty, it will not be possible to have the right of Extended warranty.
